Terms & Conditions

These general terms and conditions apply to all purchase orders placed by customers at the online shop www.peersstories.com, operated by Peers Sagl, Crocicchio Cortogna 2, 6900 Lugano, Switzerland (hereinafter referred to as “Peers”). 

Please read our Terms and Conditions carefully before placing any orders. By placing an order, you enter into an agreement with Peers and accept these Terms and Conditions. The following general Terms and Conditions apply exclusively and only in the form in which they apply at the time the customer places the order.  We may modify the Terms and Conditions from time to time. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

Contract conclusion

The present Terms and Conditions have the aim of defining the rights and obligations of the various parties within the framework of the online sale of goods and services proposed by the Peers company to the customer, from the order to the delivery, including payment and the use of services made available by Peers.

By submitting an order, the customer expressly agrees to these Terms and Conditions. All orders are binding as soon as the customer presses the buy button. This creates a legally valid purchase contract, which is confirmed by an order confirmation by email from Peers.

This confirmation is non-binding, and does not mean that the ordered merchandise is in stock at the time of the order. Peers can only accept orders if the ordered merchandise is available. Once placed, an order cannot be cancelled by the customer. A contract closure only comes into effect with the delivery of the merchandise. 
If the merchandise is no longer available from the supplier, Peers has the right not to execute an order and to refund any payments already effectuated by the customer.

For deliveries in Switzerland all prices are listed in Swiss Francs including VAT and excluding delivery costs.
For all other countries prices are VAT excluded. Shipping costs will be stated separately.  

Any statutory VAT applicable in a given country, and any customs duties, are payable by the customer and will be charged by the competent customs authorities.

Your payment options for orders with peersstories.com are via STRIPE (Visa, MasterCard, American Express) or Paypal. Any fees charged by the card institutes when paying by credit card are at your expense. The final amount charged to customers, depends on the currency conversion performed by the customer's bank.

Delivery

Deliveries within Switzerland we charge a shipping cost of 5.– CHF. All shipments are dispatched by Swiss Post Economy Service. Deliveries within Switzerland take approximately 3-5 business days.

Deliveries to EU we charge a shipping cost of 15.– CHF. All shipments are dipatched by Swiss Post Priority Service. This means every delivery has a tracking number that allows our customer to monitor the delivery at all times. Orders above 200.– CHF are shipped for free. Deliveries to EU take about 10 business days with priority delivery. 
Deliveries to all other countries we charge a shipping cost of 35.– CHF. All international shipments are dispatched by Swiss Post Priority Service. This means every delivery has a tracking number that allows our customer to monitor the delivery at all times.Orders above 300.– CHF are shipped for free. Worldwide deliveries take about 14 business days with priority delivery. 
All shipments will be dispatched after successful payment.
Should delivery not be possible after several tries Peers can withdraw from the contract.

Returns & Claims

Peers grants a voluntary right of return of 30 days (postmark). Please contact us at peersstories@gmail.com, in order to assist you. The return of the goods is at the responsibility and expense of the customer. Customs duties, import sales taxes and handling charges will not be refunded if the goods are returned. A prerequisite for exercising the right of return is that the customer sends the goods back completely undamaged, with tags. Peers does not take back worn, soiled & used products. Sale products can neither be exchanged nor refunded. The repayment is always made to the account used by the customer for payment. The customer ensures that he has access to the specified bank account since Peers assumes no liability for this. When paying on account, the remittance will be transferred to the account from which the remittance was made. When paying by PayPal or credit card, the refund will be made to the associated PayPal or credit card account.

Peers asks the customer to check the delivered items immediately for completeness and integrity. Complaints are to be reported within 5 working days after receipt of the goods in writing by email with a photo to peersstories@gmail.com. The defect will be checked by Peers immediately. If the defect is accepted by Peers, the customer will receive the same replacement item, if available. Otherwise, the amount of the product will be refunded to the customer. The warranties of the purchased items from Peers are limited to the assurances of the respective manufacturer.

Disclaimer of liability

Peers assumes no liability for the correctness, accuracy, timeliness, reliability and completeness of the information. Liability claims against Peers due to material or immaterial damage arising from the access or use or non-use of the published information, misuse of the connection or technical faults are excluded. All offers are non-binding. Peers expressly reserves the right to change, supplement or delete parts of the pages or the entire offer or to temporarily or permanently cease publication without prior notice.

Data Protection

Based on Article 13 of the Swiss Federal Constitution & the Data Protection provisions of the Confederation (Data Protection Act, DSG), every person has the right to protection of their privacy and protection against misuse of their personal data. Peers complies with these regulations. Personal data are kept strictly confidential and are neither sold nor passed on to third parties.

In close cooperation with the hosting providers, Peers endeavors to protect the databases as well as against unauthorised access, loss, misuse or counterfeiting.

 When accessing the website, the following data is stored in log files: IP address, date, time, browser request & general information about the operating system and browser. This usage data forms the basis for statistical, anonymous evaluations, so that trends can be identified, on the basis of which offers can be improved accordingly. 

All legal disputes arising out of or in connection with a purchase contract shall be governed exclusively by Swiss law. The jurisdiction is Lugano. The CISG does not apply.
